ACTION REQUEST
Consider and take action on Ordinance No. 22-21, amending Chapter 150 "Building Regulations; Construction” related to additional authority regarding substandard structures.
BACKGROUND (Brief Summary)
There is a need to clarify the additional authority regarding substandard structures. Specifically, stabilization, securing and updating an identified substandard structure to current City Codes and Ordinances, the timeliness of the abatement procedures, and recognizing the delay caused by environmental issues and compliance as related to commercial structures. The amendment also addresses when and under what circumstance an Order from the Court may be required.
RECOMMENDATION
Amendments are requested to further clarify the ordinance and ensure that all parties are afforded an opportunity to discuss and understand what is required when a structure has been declared substandard and the responsible party has expressed a desire to renovate the property in lieu of abatement. In those instances where abatement is the only option, the ordinance would now take into account that electrical and other utilities must be disconnected prior to abatement and the City has no control over how long that process may take. In the case of commercial structures, asbestos testing, bidding procedures, and state waiting periods must be adhered to which further delays the 72-hour abatement after proper notice has been delivered.
The Fire Chief and the Fire Marshal both recommend approval of the proposed amendments.
