ACTION REQUEST
Consider and take action on Ordinance No. 22-20, amending the Texas City Code of Ordinance
Title XI. Business Regulations, Chapter 112, Vehicles For Hire, Section: Automobile Wreckers
to update information contained in the Code and to correct Scrivener’s errors.
BACKGROUND (Brief Summary)
The current Ordinance does not include the removal of junk vehicles by Neighborhood Improvement Services (NIS) as part of code enforcement activities. The proposed amendment creates two (2) master lists for automobile wrecker call out services by the City. The first one for use by the Police Department and the second list for use by NIS for code enforcement abatement.
RECOMMENDATION
A request was made to Neighborhood Improvement Service (NIS) by a permitted automobile wrecker service provider to establish two (2) master lists so that a permitted provider was not losing opportunities to provide services to the police department because they had been requested by NIS and responded to that request. By rule, a provider drops to the bottom of the single master list and is losing out on opportunities for service calls requested by the police department. Police department responses historically pay quicker than NIS requests because with a junk vehicle the service provider must complete state required paperwork and await the statutory time period before salvaging a junk vehicle.
The Fire Chief, Police Chief and City Attorney have discussed the proposed amendment and recommend approval.
